By accessing or using our website, services, interactive tools, and cognitive cessation dashboard at mindfulunsmoke.com, you agree to comply with and be bound by the following Terms of Service. 1. Eligibility & Minimum Age (18+)

You must be at least 18 years old (or the age of legal majority and legal nicotine purchase age in your jurisdiction, whichever is greater) to access or use Mindful Unsmoke. By creating an account or using the service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these terms.

2. Educational and Psychological Support Tool – Not Medical Advice

Mindful Unsmoke is strictly an educational, psychological, and behavioral habit-reframing tool designed to assist individuals in managing behavioral cravings through cognitive behavioral principles (CBT) and somatic grounding techniques.

Mindful Unsmoke is not a healthcare provider, medical clinic, or certified medical device. The content, physiological recovery timelines, dynamic health indicators, and interactive exercises provided on our platform are for informational and motivational purposes only. They do not constitute clinical medical diagnosis, prescription advice, or psychiatric treatment.

Nicotine withdrawal and smoking cessation can produce physiological and psychological symptoms. Always consult a qualified physician or healthcare provider regarding any clinical health concerns, prescription cessation aids, or underlying medical conditions before undertaking any cessation program.

3. User Accounts and Security

To access personalized progress metrics and dashboard tools, you must register an account. You agree to provide accurate, current, and complete information during registration.

You are solely responsible for maintaining the confidentiality of your credentials and password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or security breach at support@mindfulunsmoke.com. We are not liable for any losses resulting from unauthorized account usage.

4. Acceptable Use and Prohibited Conduct

You agree to use Mindful Unsmoke only for lawful purposes. You shall not:

• Interfere with, disrupt, or compromise the integrity of our servers, networks, or API endpoints.
• Attempt to reverse engineer, decompile, scrape, or extract source code from the application.
• Transmit automated scripts, bots, spiders, crawlers, or unauthorized automated requests.
• Impersonate any individual, entity, or misrepresent affiliation with Mindful Unsmoke.
• Use the platform for any fraudulent or illegal activity.

5. Intellectual Property Rights

All materials on Mindful Unsmoke—including software code, text, visual design, Truth School educational curricula, Somatic Urge Surfing frameworks, bubble-pop engine, brand names, and logos—are the exclusive intellectual property of Mindful Unsmoke and are protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to access and use our web platform for your individual, non-commercial smoking cessation efforts.

6. Disclaimer of Warranties

Mindful Unsmoke is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the application will be uninterrupted, error-free, completely secure, or that any individual will achieve complete nicotine cessation by using our companion. Cessation success varies based on individual adherence, psychology, and personal circumstance.

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Mindful Unsmoke, its founders, operators, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages—including without limitation loss of profits, data, personal injury, psychological distress, or cessation relapse—arising out of or related to your use of or inability to use the service.

8. Indemnification

You agree to indemnify, defend, and hold harmless Mindful Unsmoke and its operators from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the service, or your violation of any applicable law.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mindful Unsmoke operates, without regard to its conflict of law provisions.

Prior to initiating any formal legal proceeding, you agree to contact us informally at support@mindfulunsmoke.com and attempt in good faith to resolve any dispute, claim, or controversy arising out of these Terms for a period of at least thirty (30) days.

10. Termination

You may terminate these Terms at any time by closing your account and ceasing all use of the platform. You may delete your account and data permanently at any time via Account Settings. We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if you violate any provision of these Terms.

We reserve the right to modify or replace these Terms at any time. Any revisions will be reflected with an updated “Last Updated” date. Your continued use of Mindful Unsmoke following any modifications constitutes acceptance of the new Terms.
